These Terms and Conditions (“Terms”) govern the services provided by YUNIQ CARDS MANAGEMENT SERVICES L.L.C. (“YUNIQ”, “we”, “us”, “our”).

By requesting or using our services, whether in-person at our kiosk or through our website, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree, you must not use our services.


1. Nature of the Services

YUNIQ provides a bespoke aesthetic card-customization service at the explicit request of the lawful cardholder.

The service consists primarily of aesthetic customization of a customer-provided card or card assembly, including premium finishing, engraving, and related presentation-oriented customization features.

In limited cases, the customization process may require the careful physical handling and integration of existing components from the customer’s original card into the customized card assembly where this is technically necessary for the requested customization process.

YUNIQ:

  • does not issue payment cards;
  • is not a bank, card issuer, payment institution, or financial institution;
  • does not create new payment credentials;
  • does not encode, program, replicate, or generate payment functionality;
  • does not access, read, decode, alter, or analyze chip data, PIN data, CVV/CVC data, or other payment credentials except to the limited extent strictly necessary for lawful service execution, security, fraud prevention, or compliance.

Any handling of existing card components is limited to what YUNIQ determines is strictly necessary for the requested customization process, is performed under controlled conditions, and remains subject to applicable law, internal compliance review, security requirements, and any issuer or regulatory requirements that may apply.

YUNIQ reserves the right to refuse, suspend, limit, or discontinue any requested service at any time where legal, regulatory, issuer, operational, fraud, technical, or security concerns arise.

 


 

2. No Affiliation; No Regulatory or Issuer Approval Representation

YUNIQ is an independent customization service provider. YUNIQ is not affiliated with, endorsed by, approved by, or acting on behalf of any issuing bank, payment network, card scheme, payment processor, or regulatory authority.

Nothing in these Terms, on our website, in our communications, or in our service descriptions shall be interpreted as a representation that:

  • any issuing bank has approved the requested customization;
  • any payment network has approved the requested customization;
  • any regulator has approved the requested customization; or
  • the requested customization is legally permitted in all circumstances or jurisdictions.

 


 

3. Customer Eligibility and Declarations

By using our services, you represent, warrant, and confirm that:

  • you are the lawful and authorized cardholder of the submitted card;
  • the card has not been obtained fraudulently or unlawfully;
  • you are acting only on your own behalf unless separately authorized in writing;
  • you understand that the physical card may remain the property of the issuing bank;
  • you understand that the issuing bank, payment network, or applicable law may prohibit or restrict customization, shipment, handling, or modification of the card or any of its components;
  • you are responsible for understanding your relationship with your issuing bank and any restrictions that may apply to your card;
  • where authorization from an issuing bank or other third party is required, you will provide satisfactory evidence of such authorization upon request.

YUNIQ may refuse service where identity, authorization, ownership, legality, or compliance cannot be adequately established.

 


 

4. Service Authorization; Custom Nature of Service

Before processing begins, the customer must explicitly authorize the requested service, physically or electronically.

Once processing has started, the service is considered:

  • custom;
  • personalized;
  • made to the customer’s specification;
  • irreversible in whole or in part; and
  • non-refundable except where required by mandatory law or expressly agreed by YUNIQ in writing.

YUNIQ may request additional confirmations, declarations, or supporting documents before beginning or continuing a service.

 


 

5. Service Process

A. In-Person Services

For in-person services:

  • customers may observe non-sensitive aspects of the customization process;
  • YUNIQ may restrict visibility of any processing area, workstation, or service step where sensitive information could be exposed;
  • YUNIQ may require identity verification before or during service;
  • original and customized card materials are returned directly to the customer unless YUNIQ determines that service should be refused, paused, or discontinued.

YUNIQ may structure its kiosk, service desk, or processing environment to prevent exposure of sensitive card information to bystanders or unauthorized persons, consistent with the legal opinion’s recommendation that sensitive data must never be exposed publicly.

B. Remote / Courier-Based Services

Where YUNIQ offers remote or courier-based services, such services are offered only where YUNIQ determines that adequate operational and security procedures are available.

For remote orders, YUNIQ may require:

  • approved packaging procedures;
  • tamper-evident seals or packaging;
  • documented receipt and dispatch;
  • identity verification;
  • chain-of-custody controls;
  • use of selected or approved courier methods;
  • additional verification or documentation before processing or return shipment.

YUNIQ may refuse to accept, process, or return any shipment where:

  • packaging integrity appears compromised;
  • identity cannot be verified;
  • required documentation is missing;
  • the order appears suspicious;
  • the requested service presents legal, regulatory, or security concerns.

YUNIQ does not guarantee that courier-based services are permissible under any issuer’s policies and may suspend or withdraw remote service availability at any time. This reflects the opinion’s warning that courier handling may breach issuer rules absent bank approval and requires strict security protocols.

 


 

6. Handling of Existing Card Components

In limited cases, the requested customization process may involve the careful physical handling and integration of existing components from the customer’s original card into the customized card assembly.

Such handling, where undertaken, is:

  • limited to physical assembly purposes within the customization process;
  • performed under controlled conditions;
  • subject to internal security procedures and legal review;
  • not a representation that the resulting card will be accepted, recognized, or honored by any bank, merchant, terminal, processor, or payment network.

YUNIQ does not guarantee:

  • issuer acceptance;
  • payment network acceptance;
  • terminal compatibility;
  • uninterrupted functionality;
  • continued activation or usability of any customized card;
  • compliance with any specific issuer policy or local rule outside YUNIQ’s direct control.

YUNIQ may require additional documentation, including proof of identity or evidence of issuer authorization, before undertaking any service step involving existing card components. YUNIQ may also decline any service that it considers legally uncertain or insufficiently authorized.

This wording is deliberately narrower than your current Terms, which openly offer EMV chip transfer and magnetic stripe transfer as service features.

 


 

7. Prohibited or Unsupported Requests

YUNIQ does not accept requests that, in YUNIQ’s judgment, involve or may involve:

  • unlawful copying, coding, encoding, replication, or creation of payment credentials;
  • unlawful or unauthorized use of cardholder data;
  • fraudulent, misleading, deceptive, or criminal purposes;
  • unauthorized third-party card submissions;
  • unauthorized use of trademarks, logos, or protected designs;
  • requests that conflict with YUNIQ’s compliance, fraud prevention, privacy, or security requirements.

YUNIQ may refuse or cancel any order without liability where such concerns arise.

 


 

8. Data Protection and Security

YUNIQ processes only the minimum information it determines is strictly necessary to evaluate, perform, secure, and document the requested service.

Sensitive cardholder information, where processed, is handled under controlled conditions and in a manner designed to prevent exposure to bystanders, unauthorized employees, or third parties.

YUNIQ applies technical and organizational safeguards including, where appropriate:

  • need-to-know access controls;
  • secured service devices and workstations;
  • internal handling procedures;
  • restricted employee access;
  • controlled viewing environments;
  • secure deletion practices after completion of processing;
  • fraud prevention and security monitoring.

Employees are strictly prohibited from:

  • photographing sensitive card details;
  • recording or copying sensitive payment information without authorization;
  • transferring sensitive information to external devices or unapproved systems;
  • using customer card information for any unauthorized purpose.

YUNIQ may maintain operational logs, authorization records, transaction records, identity verification records, CCTV evidence, and similar evidence where necessary for fraud prevention, operational security, dispute handling, compliance, or legal defense, provided that sensitive payment data is not retained beyond what is strictly necessary and lawfully permitted. This is broadly consistent with the legal opinion’s recommendations on shielding data, limiting access, and secure deletion.

 


 

9. Intellectual Property and Design Submissions

Customers may submit custom names, artwork, logos, insignia, graphics, or other design elements only where they have the legal right to do so.

For any third-party trademark, logo, or protected design, YUNIQ may require documentary proof of authorization, license, ownership, or rights-holder consent before accepting or processing the order.

YUNIQ reserves the right to reject, pause, or cancel any design request that appears unlawful, infringing, misleading, unauthorized, offensive, or otherwise inappropriate.

The customer remains solely responsible for the truth, completeness, and legality of all design-related representations and agrees to indemnify YUNIQ against third-party claims arising from unauthorized or infringing submissions. This tightens your current IP clause, which relied too heavily on customer self-confirmation.

 


 

10. Customer Responsibilities

The customer is responsible for:

  • providing accurate information;
  • complying with any applicable issuer requirements known to the customer;
  • monitoring the status and activity of their card account where relevant;
  • following shipping, packaging, and identification instructions provided by YUNIQ;
  • ensuring that use of the service does not violate laws or contractual obligations applicable to the customer.

The customer must promptly notify YUNIQ if:

  • their card is reported lost, stolen, blocked, or cancelled;
  • there is any fraud concern;
  • information previously provided becomes inaccurate;
  • they no longer wish YUNIQ to proceed before processing begins.

 


 

11. Compliance Reservation

YUNIQ may refuse, pause, suspend, or terminate any order where it reasonably believes that the requested service may conflict with:

  • applicable law;
  • issuer requirements;
  • payment network rules;
  • fraud prevention obligations;
  • intellectual property rights;
  • privacy or data-protection obligations;
  • internal compliance or security standards.

YUNIQ may request additional documentation at any time, including:

  • proof of identity;
  • proof of cardholder status;
  • proof of design rights;
  • proof of authorization;
  • additional written confirmations.

Failure to provide requested documentation may result in refusal or cancellation of service without liability to YUNIQ.

 


 

12. Disclaimer Regarding Functionality, Acceptance, and Issuer Action

Services are provided on an as-is and as-available basis to the maximum extent permitted by applicable law.

YUNIQ does not guarantee that:

  • any issuing bank will continue to honor, activate, or recognize a customized card;
  • any merchant, terminal, processor, or payment network will accept the customized card;
  • any card will continue to function after customization;
  • any card customization is permitted under any specific issuer’s terms or under the laws of any jurisdiction outside YUNIQ’s control.

YUNIQ shall not be liable for:

  • issuer refusal, suspension, cancellation, or deactivation;
  • merchant or terminal refusal;
  • replacement fees or administrative fees charged by third parties;
  • losses resulting from issuer policies, payment network policies, or security controls;
  • legal or contractual consequences arising from the customer’s relationship with their issuer.

 


 

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • YUNIQ’s total aggregate liability arising out of or relating to any service shall not exceed the amount paid by the customer for the specific service giving rise to the claim;
  • YUNIQ shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages;
  • YUNIQ shall not be liable for losses resulting from courier delays, customs handling, third-party carrier actions, criminal acts of third parties, or events outside YUNIQ’s reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

 


 

14. Fraud Prevention and Identity Verification

YUNIQ reserves the right to implement fraud prevention and verification measures, including:

  • identity verification;
  • cardholder verification;
  • verification of name consistency;
  • review of order details and shipping information;
  • refusal of suspicious or high-risk transactions;
  • refusal of third-party requests;
  • enhanced checks for remote orders.

Service may be refused, paused, or cancelled if:

  • identity cannot reasonably be verified;
  • fraud is suspected;
  • the card appears altered, suspicious, or inconsistent with the order;
  • requested documentation is not provided;
  • YUNIQ believes the service presents unacceptable legal, security, or compliance risk.

If required by law or where YUNIQ reasonably considers it necessary for fraud prevention or legal compliance, YUNIQ may communicate with competent authorities, service providers, or issuing banks.

 


 

15. Evidence Retention

To protect against fraud, chargebacks, legal disputes, and operational disputes, YUNIQ may retain lawful evidence including:

  • authorization forms;
  • order confirmations;
  • transaction receipts;
  • shipping records;
  • chain-of-custody records;
  • CCTV recordings;
  • proof of completion;
  • production logs;
  • verification records.

Such records may be used to establish, exercise, or defend legal claims or respond to disputes, fraud allegations, chargebacks, or compliance inquiries.

 


 

16. Marketing and Media

YUNIQ may photograph or record non-sensitive aspects of the customization process for internal quality, training, security, or marketing purposes only where lawful and appropriate.

Identifiable customer information or identifiable customer designs will not be used for marketing without separate explicit consent where required by law.

Sensitive card information and back-side card details must not be used for promotional purposes.

 


 

17. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the United Arab Emirates, to the extent applicable.

Any dispute arising out of or in connection with these Terms or the services shall be subject to the competent courts of the United Arab Emirates, unless mandatory law requires otherwise.

 


 

18. Renewal & Replacement Policy

1. Renewal Benefit

Customers may transfer a new chip into an existing metal card, once the one in usage has expired. To claim this benefit, the previously purchased metal card or proof of expiration for that card has to be shown for verification. The benefit is valid for one use per returned card, is non-transferable, cannot be combined with other offers, and does not include shipping costs.

2. Card Insurance

Card Insurance is available as an optional add-on for 200 AED. It entitles the customer to one replacement within 12 months from delivery in the event of cosmetic or accidental damage. The original metal card must be returned before a replacement is issued. The replacement applies only to the same design as originally ordered. Shipping costs are not included. Coverage is limited to one replacement per insured card and is non-transferable.

 


 

19. Changes to These Terms

YUNIQ may update these Terms from time to time. The latest version will be made available through the relevant customer-facing channel. Continued use of the services after an updated version becomes effective constitutes acceptance of the updated Terms, to the extent permitted by law.
